Welcome to The Monstera (“Monstera,” “we,” “our,” or “us”), a platform developed and operated by Ape Forge LLC. These Terms of Service (“Terms,” “Agreement”) form a legally binding agreement between you (“User,” “you,” “your”) and Ape Forge LLC regarding your use of The Monstera platform, mobile application, and related services (collectively, the “Platform”).

By accessing or using The Monstera, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

I. Use of the Platform

To use The Monstera, you may be required to create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You must be at least 18 years old to use The Monstera. By using the Platform, you represent that you are legally able to enter into this Agreement.

The Monstera provides tools to help users manage projects, track contacts, send invoices, and communicate with clients. We do not act as a party to any agreements between users or clients. All user content, project information, and communication are the responsibility of the user who created or uploaded them.

II. Data Processing and Storage

All data processed through The Monstera is stored securely within the United States. Data is encrypted both in transit and at rest using industry-standard protocols.

By using the Platform, you consent to the collection, processing, and storage of data in the United States and agree that such data may be used to provide and improve the Platform’s features.

III. Data Collection and Use

The Monstera collects and processes data you submit through the Platform, including project details, contact information, invoices, and uploaded files. This information is used solely for the purpose of delivering Monstera’s core functionality.

We may use anonymized and aggregated data to improve our platform performance, generate insights, and enhance user experience. Personal or identifiable information will never be shared publicly or with third parties without your consent, except as required by law.

Ape Forge LLC may offer optional integrations (e.g., Stripe) that involve third-party data handling; by enabling such integrations, you consent to those third parties’ applicable terms and policies.

IV. Assumption of Risk

Your use of The Monstera is at your own risk. The Platform is provided to help manage your creative business, but you are solely responsible for your data, communications, and business results.

Ape Forge LLC makes no guarantees regarding outcomes, profitability, or workflow improvements arising from use of The Monstera.

V. Account Access and Security

You are solely responsible for safeguarding your account credentials and for all activity conducted under your login.

You agree not to share your account with others or access another user’s account. If you suspect unauthorized access, you must notify Ape Forge LLC immediately.

VI. Prohibited Use

You agree not to use The Monstera for any unlawful, unethical, or prohibited activity. This includes, but is not limited to:

• Uploading or transmitting any offensive, defamatory, harassing, or malicious content.
• Attempting to interfere with the operation, security, or integrity of the Platform.
• Reverse engineering, scraping, or data-mining Monstera’s code or content.
• Impersonating another person or misrepresenting your affiliation with an entity.
• Using Monstera to spam, solicit, or engage in fraudulent or misleading activities.

Ape Forge LLC reserves the right to monitor and moderate activity on the Platform and may suspend or terminate accounts that violate these Terms.

VII. Subscription and Payment

The Monstera operates on a subscription-based model. Payments are processed securely through an authorized third-party provider (e.g., Stripe). We do not store credit card numbers or other financial data on our servers.

Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled prior to renewal.

Cancellation: You may cancel your subscription at any time by contacting support at monstera@apeforge.com. All payments are non-refundable, and no prorated refunds are offered for partial billing periods.

Nonpayment: Failure to pay subscription fees may result in suspension or termination of your account.

VIII. Data Security and Confidentiality

The Monstera employs technical, administrative, and physical safeguards to protect your data. While we follow best practices for encryption and security, no system is completely immune from unauthorized access.

“Confidential Information” includes any nonpublic information you upload, store, or transmit through the Platform. Ape Forge LLC agrees to use such information only to provide Platform functionality and to protect it with reasonable care.

We will not disclose your Confidential Information to third parties unless required by law, necessary for Platform operation (e.g., payment processing), or authorized by you.

IX. Third-Party Services and Integrations

The Monstera may integrate with third-party services such as payment processors or cloud storage providers. Use of these integrations is optional and subject to the third parties’ respective terms and privacy policies.

You acknowledge that Ape Forge LLC is not responsible for the performance, data handling, or compliance of any third-party services you choose to connect.

X. Disputes Between Users

Ape Forge LLC is not a party to user-to-user or user-client agreements. Any disputes arising from such relationships must be resolved directly between the involved parties.

We may suspend or restrict accounts involved in repeated or unresolved disputes that disrupt the community or violate these Terms.

XI. Disclaimer of Warranties

The Monstera is provided “as is” and “as available” without warranties of any kind, express or implied.

Ape Forge LLC disclaims all warranties including, but not limited to, merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, secure, or that any defects will be corrected.

XII. Limitation of Liability

To the fullest extent permitted by law, Ape Forge LLC and its affiliates, employees, officers, and contractors will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of The Monstera.

Our total liability for any claim under these Terms shall not exceed the amount you paid to use The Monstera in the twelve (12) months preceding the claim.

XIII. Termination

Ape Forge LLC reserves the right to terminate or suspend your access to The Monstera, with or without notice, for any reason including violation of these Terms.

Upon termination, your right to access and use the Platform ceases immediately. Certain sections (e.g., Confidentiality, Liability, Governing Law) will survive termination.

XIV. No Agency Relationship

Your use of The Monstera does not create a partnership, joint venture, or employment relationship with Ape Forge LLC. You do not have authority to bind Ape Forge LLC in any way.

XV. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Montana, without regard to conflict of law principles.

Any dispute arising from this Agreement shall be brought exclusively in the state or federal courts located in Missoula County, Montana, USA.

You consent to the personal jurisdiction and venue of those courts for any such dispute.

XVI. Modifications

Ape Forge LLC reserves the right to modify these Terms at any time. Updated versions will be posted on www.themonstera.io, and continued use of the Platform constitutes acceptance of those updates.
